1. Acceptance of Terms
By creating an account, accessing, or using Weekly Thoughts & Feelings ("WT&F," "Service," "we," "us," or "our"), you ("you," "User," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms constitute a legally binding agreement between you and WT&F. Please read them carefully.
If you are using the Service on behalf of an organization (such as a therapy practice), you represent that you have authority to bind that organization to these Terms.
2. Description of Service
WT&F is a personal wellness and self-tracking application designed to help individuals monitor their emotions, urges, behaviors, and use of Dialectical Behavior Therapy (DBT) skills.
2.1 What WT&F Is
- A personal diary card and mood tracking tool
- A companion to professional DBT therapy
- A way to visualize patterns in your emotional experiences
- A tool to share your tracking data with your therapist (if you choose)
2.2 What WT&F Is NOT
- NOT a healthcare provider. We do not provide medical advice, diagnosis, or treatment.
- NOT a substitute for professional mental health care. WT&F is designed to supplement, not replace, your work with a licensed therapist.
- NOT an emergency service. WT&F is not designed for use in crisis situations.
- NOT covered by HIPAA. We are not a "covered entity" under the Health Insurance Portability and Accountability Act.
2.3 Emergency Resources

Do not rely on WT&F in an emergency. The Service is not monitored for crisis situations and cannot provide emergency assistance.
3. Eligibility
To use WT&F, you must:
- Be at least 13 years of age
- If under 18, have permission from a parent or guardian
- Provide accurate and complete registration information
- Not be prohibited from using the Service under applicable law
We recommend that minors use WT&F only in conjunction with a licensed therapist and with parental awareness.
4. Account Registration and Security
4.1 Account Creation
To access WT&F, you must create an account by providing a valid email address and password. You may register as either:
- Patient Account: For individuals tracking their own mental health
- Therapist Account: For licensed mental health professionals who wish to view linked patients' data
4.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your login credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorized access
We are not liable for any loss or damage arising from your failure to protect your account credentials.
4.3 Account Accuracy
You agree to provide accurate, current, and complete information during registration and to update such information as necessary.
5. Subscription Plans and Payment
5.1 Free Tier
WT&F offers a free tier that includes:
- Core diary card functionality with default tracking items
- View entries from the last 14 days
- Edit entries within 7 days of creation
- 7-day PDF export
- Weekly comparison view
- Skills library access
- Safety plan
5.2 Premium Tier
Premium subscriptions provide additional features including:
- Full diary card customization
- Extended dashboard time ranges (up to 1 year)
- Extended PDF export (up to 28 days)
- Full entry history access
- Additional customization options
Therapist-Linked Upgrade: If you link your account to a therapist who uses WT&F, your account will automatically receive premium features at no cost to you for as long as the link remains active.
5.3 Therapist Tier
Therapist accounts provide features for mental health professionals including:
- Link up to 25 patients
- View linked patients' dashboards with extended time ranges
- Generate PDF exports for linked patients
- Linked patients receive premium features automatically
5.4 Billing and Payment
- Premium subscriptions are billed on a recurring basis (monthly or annually, as selected)
- Payment is due at the beginning of each billing cycle
- All fees are stated in U.S. dollars
- We use third-party payment processors; your payment information is subject to their terms
5.5 Automatic Renewal
Premium subscriptions automatically renew at the end of each billing cycle unless you cancel before the renewal date. You may cancel at any time through your account settings.
5.6 Refunds
- Subscription fees are generally non-refundable
- If you cancel mid-cycle, you will retain access until the end of your current billing period
- We may offer refunds at our discretion on a case-by-case basis
5.7 Price Changes
We reserve the right to change our pricing. Any price changes will be communicated to you in advance and will take effect at the start of your next billing cycle.
6. Therapist Linking Feature
6.1 For Patients
If you choose to link your account to a therapist:
- You initiate the connection by entering your therapist's unique linking code
- Your therapist will be able to view your diary entries, tracked items, safety plan, and trends
- You may unlink from your therapist at any time through your account settings
- Unlinking removes your therapist's access to your data going forward
6.2 For Therapists
If you register as a therapist and link with patients:
- You represent that you are either: (a) a licensed mental health professional, or (b) a pre-licensed clinician (such as an associate therapist, trainee, or social worker) working under the supervision of a licensed professional
- If you are a pre-licensed clinician, you represent that your use of WT&F is within the scope of your supervised practice
- You agree to use patient data solely for clinical purposes related to the patient's care
- You will maintain appropriate confidentiality of patient data
- You will comply with all applicable professional and legal obligations
- You may unlink from a patient at any time
- You may link with up to 25 patients
6.3 Relationship Between Parties
- WT&F facilitates data sharing but is not a party to the therapist-patient relationship
- We are not responsible for any clinical decisions made based on WT&F data
- The therapist-patient relationship is governed by applicable professional standards and laws, not by these Terms
7. User Content and Data
7.1 Your Content
You retain ownership of all content you create in WT&F, including:
- Diary entries
- Notes
- Safety plan information
- Customization preferences
7.2 License to Us
By using WT&F, you grant us a limited license to store, process, and display your content solely for the purpose of providing the Service to you. We will not use your content for any other purpose without your consent.
7.3 Data Handling
Your data is handled in accordance with our Privacy Policy. By using WT&F, you consent to our collection and use of data as described in that policy.
7.4 Data Retention
- Your data is retained as long as your account is active
- You may delete individual entries at any time
- You may delete your entire account, which will result in permanent deletion of your data within 30 days
- Database backups may retain deleted data for up to 90 days for disaster recovery
8. Acceptable Use
8.1 You Agree NOT To:
- Use WT&F for any unlawful purpose
- Impersonate any person or entity
- Share your account credentials with others
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the Service or servers
- Use automated means to access the Service without permission
- Reverse engineer, decompile, or disassemble any part of the Service
- Use the Service to harass, abuse, or harm others
- Upload malicious code or content
8.2 Therapist-Specific Obligations
Therapists using WT&F agree to:
- Only access data of patients who have linked with them
- Not share patient data except as permitted by law and professional standards
- Use the Service in compliance with applicable licensing requirements
- Maintain appropriate professional boundaries
8.3 Violations
We reserve the right to suspend or terminate your account for violations of these Terms, with or without notice.
9. Intellectual Property
9.1 Our Property
WT&F, including its design, features, code, content, and logos, is our original work and is protected by copyright law. The names "Weekly Thoughts & Feelings" and "WT&F" as used in connection with this Service are our trademarks. You may not copy, modify, distribute, or create derivative works based on the Service without our written permission.
9.2 Skills Library Content
The DBT skills descriptions in WT&F are original content created for this application. DBT as a therapeutic modality was developed by Dr. Marsha Linehan. Our skills descriptions are provided for educational purposes only.
9.3 Feedback
If you provide us with feedback, suggestions, or ideas about the Service, you grant us the right to use such feedback without compensation or attribution to you.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
- WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
- WARRANTIES REGARDING THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE SERVICE
WE DO NOT WARRANT THAT:
- The Service will meet your specific requirements
- The Service will be available at all times
- Any errors in the Service will be corrected
- The Service is free of viruses or harmful components
11. Limitation of Liability
11.1 No Liability for Mental Health Outcomes
WT&F IS NOT A HEALTHCARE PROVIDER AND DOES NOT PROVIDE MEDICAL ADVICE.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR:
- Any mental health outcomes, whether positive or negative
- Any decisions you make based on information in the Service
- Any actions taken or not taken by you or your therapist
- Any harm resulting from reliance on the Service
- Any delay or failure to seek professional help
11.2 General Limitation
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- WE SHALL NOT BE LIABLE FOR ANY LOSS OF DATA, PROFITS, REVENUE, OR GOODWILL
- OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100
11.3 Essential Basis
YOU ACKNOWLEDGE THAT THE LIMITATIONS IN THIS SECTION ARE AN ESSENTIAL BASIS OF THE BARGAIN BETWEEN YOU AND US, AND THAT WE WOULD NOT PROVIDE THE SERVICE WITHOUT THESE LIMITATIONS.
11.4 Jurisdictional Limitations
Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.
12. Indemnification
You agree to indemnify, defend, and hold harmless WT&F and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of another person or entity
- Any content you submit to the Service
13. Termination
13.1 Termination by You
You may terminate your account at any time by:
- Deleting your account through the app settings
- Contacting us at support@diary-card.com
Upon termination, your data will be deleted in accordance with our Privacy Policy.
13.2 Termination by Us
We may suspend or terminate your account at any time, with or without cause, with or without notice. Reasons for termination may include:
- Violation of these Terms
- Conduct that we believe is harmful to other users or the Service
- Extended periods of inactivity
- Requests by law enforcement
13.3 Effect of Termination
Upon termination:
- Your right to access the Service will cease immediately
- We may delete your data (subject to our Privacy Policy)
- Provisions of these Terms that by their nature should survive will survive (including Sections 10, 11, 12, 14, and 15)
14. Dispute Resolution
14.1 Informal Resolution
Before filing any formal dispute, you agree to contact us at support@diary-card.com and attempt to resolve the dispute informally for at least 30 days.
14.2 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.
14.3 Jurisdiction
Any disputes arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction of such courts.
14.4 Class Action Waiver
TO THE EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS AND NOT AS PART OF ANY CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
15. General Provisions
15.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements.
15.2 Modifications
We may modify these Terms at any time. We will notify you of material changes by:
- Posting the updated Terms on the Service
- Updating the "Last Updated" date
- Sending you an email notification (for material changes)
Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.
15.3 Severability
If any provision of these Terms is found to be unenforceable, that provision shall be modified to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
15.4 Waiver
Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
15.5 Assignment
You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction.
15.6 Notices
We may provide notices to you via email, in-app notification, or posting on the Service. You may provide notices to us at support@diary-card.com.
15.7 No Agency
Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and us.
